By accessing and using the Beatstave application ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
Beatstave is a web-based audio sequencing and drum machine application. The service allows users to create, save, playback, and export audio sequences and standard drum sheet notation. We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice.
To access certain features (like cloud saving), you must authenticate via Google Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. Beatstave cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.
You retain full ownership of the unique musical patterns you create using Beatstave. By saving your patterns to our cloud servers, you grant Beatstave a worldwide, non-exclusive, royalty-free license to store, process, and display that content solely for the purpose of providing the Service to you. You are solely responsible for the content you create and share. We reserve the right to remove any content that violates these terms or is deemed abusive or harmful.
The Service and its original content, features, functionality (including the UI, codebase, graphical assets, and default audio samples), and algorithms are and will remain the exclusive property of Beatstave and its licensors. The Service is protected by copyright, trademark, and other laws.
You agree not to use the Service to:
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Beatstave expressly disclaims all warranties of any kind, whether express or implied. We make no warranty that (i) the Service will meet your requirements, (ii) the Service will be uninterrupted, timely, secure, or error-free, or (iii) the results that may be obtained from the use of the Service will be accurate or reliable. We do not guarantee permanent storage of your cloud saves; please ensure you export important data.
In no event shall Beatstave, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory.
You agree to defend, indemnify and hold harmless Beatstave and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.
These Terms shall be governed and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions.
